Terms of Service

Please read these terms carefully before using our services. By using ZConverter, you agree to these terms.

1. Acceptance of Terms

  • By accessing or using ZConverter services, you agree to be bound by these Terms of Service and all applicable laws and regulations.
  • If you do not agree with any of these terms, you are prohibited from using or accessing our services.
  • We reserve the right to modify these terms at any time. Continued use of the service after changes constitutes acceptance of the modified terms.

2. Service Description

  • ZConverter provides enterprise cloud migration, backup, disaster recovery, and cloud mobility services.
  • Our services include but are not limited to: automated workload migration, continuous data replication, scheduled backups, disaster recovery orchestration, and multi-cloud management.
  • Service availability, features, and pricing may vary by subscription plan and region.

3. Account Registration

  • You must provide accurate, complete, and current information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must immediately notify us of any unauthorized use of your account.
  • One person or legal entity may not maintain more than one account without prior written consent.

4. Acceptable Use

  • You agree to use our services only for lawful purposes and in accordance with these Terms.
  • You must not use our services to transmit malware, viruses, or any code of a destructive nature.
  • You must not attempt to gain unauthorized access to any portion of our services or any other systems connected to our services.
  • You must not interfere with or disrupt the integrity or performance of our services.
  • You must not use our services to store or transmit content that infringes intellectual property rights.

5. Service Level Agreement (SLA)

  • ZConverter guarantees 99.9% uptime for production services, measured on a monthly basis.
  • Scheduled maintenance windows are excluded from uptime calculations and will be communicated at least 48 hours in advance.
  • In the event of SLA breach, customers are eligible for service credits as detailed in the applicable SLA document.
  • Force majeure events, customer-caused issues, and third-party service disruptions are excluded from SLA coverage.

6. Data Ownership and Responsibility

  • You retain all ownership rights to your data. ZConverter does not claim ownership of any content you store or process through our services.
  • You are solely responsible for the legality, reliability, and appropriateness of data stored using our services.
  • ZConverter will not access your data except as necessary to provide the services or as required by law.
  • Upon termination of service, you may request export of your data within 30 days. After this period, data may be permanently deleted.

7. Payment Terms

  • Fees are billed in advance on a monthly or annual basis, depending on your subscription plan.
  • All fees are non-refundable unless otherwise specified in your service agreement.
  • We reserve the right to modify pricing with 30 days written notice.
  • Late payments may result in service suspension. Accounts with payments overdue by more than 30 days may be terminated.

8. Limitation of Liability

  • ZConverter shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • Our total liability for any claims arising from the use of our services shall not exceed the amount paid by you in the 12 months preceding the claim.
  • We do not guarantee that our services will be uninterrupted, timely, secure, or error-free.

9. Termination

  • Either party may terminate the service agreement with 30 days written notice.
  • ZConverter may immediately terminate or suspend access for violation of these Terms.
  • Upon termination, your right to use the services will immediately cease.
  • Sections relating to intellectual property, limitation of liability, and governing law shall survive termination.

10. Governing Law

  • These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea.
  • Any disputes arising from these Terms shall be submitted to the exclusive jurisdiction of the courts located in Incheon, South Korea.
  • If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
